BETA TESTING AGREEMENT
This Beta Testing Agreement (the “Agreement”) is made by and between twitreview UK (owned by Fowte UK Ltd whose registered office is The Old Surgery Cannerby Lane Norwich Norfolk United Kingdom NR7 8NQ. Our company registration number is 07155691, and You (the “User”).
GENERAL TERMS AND CONDITIONS
A. twitreview UK operates a food establishment review site at twitreview.co.uk. twitreview UK has developed a system that enables the User to submit a review of any UK based food establishment via twitter.com and using a Twitter account. The User is able to search the system for food establishments and read the submitted reviews
B. twitreview UK desires that the system be tested prior to general release.
C. You wish to serve as a Beta tester of the system.
D. You accept these terms & conditions by way of registering your intent to serve as a beta tester or by using the system to either submit a review or search for a business
NOW, THEREFORE, in consideration of the mutual covenants and premises herein contained, the parties hereto agree as follows:
I. twitreview UK grants to You a non-exclusive, non-transferable license to use the system for Beta testing and Beta use from effective date of this Agreement subject to the terms and conditions below.
II. You agree to serve as a Beta tester for the system and will notify twitreview UK of all problems and ideas for enhancements which come to the your attention during the period of this Agreement, and hereby assign to twitreview UK all rights, title and interest to such enhancements and all property rights therein including without limitation all patent, copyright, trade secret, mask work, trademark, moral right or other intellectual property rights. Such problems and ideas shall be directed to enquiries@twitreview.co.uk
III. You agree to respond to reasonable inquiries from twitreview UK with regard the functionality, performance and overall experience with respect to the system. You, upon completion of the Beta test agree to provide material, statistics, or information that is not deemed confidential to your business, for use in press releases, customer testimonials, and as a reference in marketing and sales initiatives by twitreview UK. You agree,if asked, to provide a quote to twitreview UK that may be used in a public statement. You hereby assign to twitreview UK all right, title and interest to such communications and resulting enhancements and all property rights therein including without limitation all patent, copyright, trade secret, mask work, trademark, moral right or other intellectual property rights.
IV. You understand and agree that You are solely responsible for the content of any review submitted and the consequences of posting it. twitreview UK does not endorse any content or any opinion, recommendation, or advice expressed therein, and twitreview UK expressly disclaims any and all liability in connection with content.
V. Your rights with regards to the content submitted are governed by twitter.com’s Terms of Service which can be found at twitter.com/tos and are titled ‘Your Rights’
VI. The system is a prerelease product and is not at the level of performance or compatibility of a final, generally available product offering. The system may not operate correctly and may be substantially modified prior to first commercial availability, or may be withdrawn. The system is provided “AS IS” without warranty of any kind. The entire risk arising out of the use or performance of the system remains with You. In no event shall twitreview UK be liable for any damage whatsoever arising out of the use of or inability to use the system, even if twitreview UK has been advised of the possibility of such damages. twitreview UK has no responsibility or liability for the deletion of, or the failure to store or to transmit, any content and other communications maintained by the twitter.com outside of twitter.com’s own terms and conditions relating to third party developers. We make no warranty that the twitreview UK will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from twitreview UK or through the twitreview UK, will create any warranty not expressly made herein
VII. You agree that the system is the sole property of twitreview UK until it is officially released and includes valuable trade secrets of twitreview UK. You agree to treat the system as confidential and will not without the express written authorisation of twitreview UK:
- Publish or otherwise disclose information relating to performance or quality of the system to any third party.
- Modify, reuse, disassemble, decompile, reverse engineer or otherwise translate the system or any portion thereof.
VIII. twitreview UK may contain links to third-party websites or resources. You acknowledge and agree that we are not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by twitreview UK of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources
IX. This Agreement shall be governed, construed and enforced in accordance with the laws of England and Wales. Any notice required by this Agreement shall be given by prepaid, first class, certified mail, return receipt requested to above address or such other address as may be given from time to time under the terms of this notice provision.
X. This Agreement constitutes the entire and only agreement between the parties for system and all other prior negotiations, representations, agreements, and understandings are superseded hereby. No agreements altering or supplementing the terms hereof may be made except by means of a written document signed by the duly authorised representatives of the parties.
XI. You shall comply with all applicable local laws, regulations, and ordinances in connection with its activities pursuant to this Agreement.
XIII. If any provision of this Agreement shall be found by a court to be void, invalid or unenforceable, the same shall be reformed to comply with applicable law or stricken if not so conformable, so as not to affect the validity or enforceability of this Agreement.

twitreview UK is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, and then you can be assured that it will only be used in accordance with this privacy statement.
twitreview UK may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from 1st February 2011.
What we collect
We will only collect information pertaining to you that is included as part of the Twitter API. If you are subscribed to our blog or registered as a beta tester of twitreview then we will also keep a copy of the email address that you provided to us as part of the subscription or registration process. We will of course retain the reviews that are submitted as they will help form an overview of the business
What we do with the information we gather
We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:
- Internal record keeping.
- We may use the information to improve our products and services.
- We may periodically send emails (to those registering their email address) about new products, services or other enhancement which we think you may find interesting using the email address which you have provided.
